For Fax, Email and SMS Broadcasting
EC and UK Data Protection Legislation has changed significantly within the last couple of years and it is essential that you follow the rules below – these are not guidance, but law:
Fax
It is illegal to fax personal fax numbers without the owners implicit consent. This also includes partnerships which could be large organisations such as solicitors’ practices.
You should also remove any names that appear on the FPS – Fax Preference Service Opt-Out List.
Email
It is illegal to send an email to any personal email address without the owners implicit consent. Corporate email addresses can be sent un-solicited mail, but identifying which are corporate email addresses within a database can prove problematic.

SMS
It is illegal to send an SMS text message to any mobile telephone without the owners implicit consent.
